“Refer a friend” promotion terms and conditions
1. Acceptance of terms
By participating in the promotion, you are deemed to accept these Terms.
2. Eligibility
2.1 Except as set out at clauses 2.2 and 2.3 below, the promotion is open to New Zealand residents, who are at least 18 years old and are a member of a KiwiSaver scheme.
2.2 The following persons cannot participate in the promotion:
(a) our employees, contractors, directors, or shareholders; or
(b) immediate family members of any of the above.
2.3 Acting reasonably, we may exclude any person from participating in the promotion.
3. How to participate
To participate in the promotion, you must switch to our recommended KiwiSaver fund using the platform at app.bettersaver.co.nz (if you have not already done so), and request a unique URL address from us by providing details of a friend, who is not a current or former BetterSaver client, and who is interested in our services, through the request form.
4. Reward
4.1 We will make a $50 contribution to your KiwiSaver scheme and a $50 contribution to your friend’s KiwiSaver scheme (the ‘reward’) if:
(a) your friend joins BetterSaver using the unique URL address we give you and switches to the KiwiSaver fund we recommend for them;
(b) your friend is still a BetterSaver client and invested in their recommended KiwiSaver fund 30 days after your friend joins BetterSaver and switches to their recommended KiwiSaver fund;
(c) you are still a BetterSaver client and invested in your recommended KiwiSaver fund 30 days after your friend joins BetterSaver and switches to their recommended KiwiSaver fund; and
(d) all other requirements of these Terms are met.
4.2 We won’t pay a reward if your friend is already a BetterSaver client, or if they join without using the unique URL address we give you (this includes where they join using a different unique URL).
4.3 Regardless of how many friends you refer, the maximum amount we will contribute to your KiwiSaver scheme is [$1000].
4.4 All participants must be eligible for a reward under clause 4.1 by 11:59pm on Sunday 31 October 2021 or such later date as we may determine in order to receive a reward.
4.5 The person who receives a reward is responsible for any tax or other costs arising in relation to, or associated with, the reward.
5. Payment
5.1 A reward cannot be received in or redeemed for cash, and cannot be transferred to another person or exchanged. However, if a reward is not available for any reason, we reserve the right to substitute the reward with another reward of similar value.
5.2 We may refuse to pay a reward to any person who, in our view:
(a) is ineligible under these Terms;
(b) has acted in a fraudulent manner;
(c) has breached these Terms, or any of our other terms and conditions; or
(d) has gained an unfair advantage in participating in the promotion.
5.3 Our determination of whether a reward is to be paid is final and binding, and no correspondence or other communication will be entered into.
5.4 We may refuse to pay a reward to a person if they do not provide us with proof of their identity (such as by providing a copy of their driver’s licence, passport or birth certificate), their residential address, their IRD number, proof of a participant sharing the unique URL address with the friend (if applicable) and any other information required for us to make a contribution to their KiwiSaver account or comply with other legal requirements.
6. Publicity and promotions
6.1 By providing us with an email address and/or a mobile phone number, you consent to us sending you electronic messages for promotional purposes. Any electronic message that we send to you will include instructions explaining how you can unsubscribe from further electronic messages.
6.2 We may use a participant’s name, details and photographs for promotional and media purposes, and participants agree to participate in any publicity arrangements which we reasonably require, in each case without compensation.
7. Privacy
7.1 You authorise us to collect, hold and use your personal information for the purpose of conducting the promotion, providing you with notifications or information regarding our products or services, engaging in publicity activities under clause 6 or for any other purpose specified in our privacy policy (which can be found on our website).
7.2 We will not share your personal information except in connection with the purpose for which it is obtained or otherwise as permitted by New Zealand privacy laws.
7.3 You understand that you have a right of access to, and may request correction of, personal information held by us about you, which you may exercise by contacting us on [email protected].
8. General
8.1 We will not be liable for any loss, damage or injury (including but not limited to any indirect or consequential loss) suffered or incurred by you (or any other person) as a result of or in connection with the promotion or a reward, except for any liability which cannot be excluded by law.
8.2 We may, in our sole discretion and at any time, replace or amend these Terms or modify, suspend, terminate or cancel the promotion.
9. Defined terms and interpretation
9.1 In these Terms, the following words have the following special meanings:
Terms means these promotion terms and conditions (as amended from time to time);
KiwiSaver has the meaning given to it by the KiwiSaver Act 2006;
we, our, us means BetterSaver Limited; and
you means a person entering the promotion.
9.2 For convenience, these Terms have been grouped under different headings, but the headings do not affect the meaning of these Terms.
