WAITLIST COMPETITION TERMS AND CONDITIONS
1 Acceptance of Terms
By entering the competition, you are deemed to accept these Terms.
2.1 Except as set out at clauses 2.2 and 2.3 below, the competition is open to New Zealand residents, who are at least 18 years old and are a member of a KiwiSaver scheme.
2.2 The following persons cannot enter the competition:
(a) our employees, directors or shareholders; or
(b) immediate family members of any of the above.
2.3 Acting reasonably, we may exclude any person from entering into the competition.
3.1 You may only enter the competition in accordance with this clause 3.
3.2 To enter the competition, you must join our Waitlist and submit an entry form using our website at www.bettersaver.co.nz. Upon successfully joining our Waitlist and completing the entry form you will receive one entry in the competition and a unique URL address which you may share with your contacts inviting them to join the Waitlist.
3.3 You may then obtain additional entries in the competition by sharing the unique URL address with your contacts. For each contact who uses your unique URL address to join our Waitlist and who satisfies the eligibility criteria in this clause 3, you will receive an additional entry into the competition. You must only share the unique URL address with your contacts where they expressly consent to receive the message from you or you can reasonably infer that they would consent to receive the message from you.
3.4 All entries must be received by 5.00 pm on Sunday 4th October 2020 or such later date as we may determine. We cannot accept responsibility for any lost, misplaced, damaged, late or incomplete entries.
4.1 There shall be five prizes each in the amount of $10,000 each. Each prize will be paid to a prize winner as a contribution to their KiwiSaver scheme.
4.2 A prize cannot be received in or redeemed for cash, and cannot be transferred to another person or exchanged.
4.3 If a prize is not available for any reason, we reserve the right to substitute the prize with another prize of similar value.
4.4 The winner of a prize is responsible for any tax or other costs arising in relation to, or associated with, the prize.
5.1 The prize winners will be determined by random draw on Monday 12th October 2020 or such later date as we may determine. Only a person who originally entered the competition in accordance with clause 3.2 is eligible to win a prize. If a person has multiple entries and their entries are drawn more than once, that person shall only be entitled to win a single prize, and there will be further draws as required to determine other prize winners until all five prizes have been allocated to five different entrants.
5.2 We will notify the prize winners by phone or email, using the details on the entry form. If a prize winner fails to claim his or her prize within ten days following notification, the prize will be forfeited.
5.3 We may refuse to award a prize to any person who, in our view:
(a) is ineligible (in terms of clause 3);
(b) has acted in a fraudulent manner;
(c) has breached these Terms; or
(d) has gained an unfair advantage in participating in the competition.
5.4 Our determination of the prize winners will be final and binding, and no correspondence or other communication will be entered into.
5.5 We may refuse to award a prize to a prize winner if they do not provide us with proof of their identity (such as by providing a copy of their driver’s licence, passport or birth certificate), their residential address, their IRD number and any other information required for us to make a contribution to a prize winner’s KiwiSaver account.
5.6 If clause 5.2, 5.3 or 5.5 applies, we may instead offer the prize either to the entrant whose name is next drawn at random or in a future competition.
6 Publicity and Promotions
6.1 By providing us with an email address and/or a mobile phone number, you consent to us sending you electronic messages for promotional purposes. Any electronic message that we send to you will include instructions explaining how you can unsubscribe from further electronic messages.
6.2 We may use a prize winner’s name, details and photographs for promotional and media purposes, and prize winner’s agree to participate in any publicity arrangements which we reasonably require, in each case without compensation.
7.2 We will not share your personal information except in connection with the purpose for which it is obtained or otherwise as permitted by New Zealand privacy laws.
7.3 You understand that you have a right of access to, and may request correction of, personal information held by us about you, which you may exercise by contacting us on [firstname.lastname@example.org].
7.4 If you fail to provide the personal information requested on the entry form, we may refuse to accept your entry.
8.1 We will not be liable for any loss, damage or injury (including but not limited to any indirect or consequential loss) suffered or incurred by you (or any other person) as a result of or in connection with the competition or a prize, except for any liability which cannot be excluded by law.
8.2 We may, in our sole discretion and at any time, replace or amend these Terms or modify, suspend, terminate or cancel the competition.
9 Defined Terms and Interpretation
9.1 In these Terms, the following words have the following special meanings:
“Terms” means these competition terms and conditions (as amended from time to time);
“KiwiSaver” has the meaning given to it by the KiwiSaver Act 2006;
“we”, “our”, “us” means Bettersaver Limited;
“Waitlist” means our waitlist of people who wish to receive a notification when our new Bettersaver 2.0 website goes live and (possibly) early access to that new website; and
“you” means a person entering the competition.
9.2 For convenience, these Terms have been grouped under different headings, but the headings do not affect the meaning of these Terms.
